WAIVER AND RELEASE OF LIABILITY
PLEASE READ CAREFULLY BEFORE SIGNING
In consideration for being allowed to participate in golf and related activities at the above-named golf course, I hereby agree to the following:
1. ASSUMPTION OF RISK:
I acknowledge that golf and related activities involve inherent risks, including but not limited to:
- Injuries from errant golf balls or clubs
- Slips, trips, or falls on uneven or natural terrain
- Hazards related to golf cart use
- Changing weather conditions
- The actions or negligence of other participants or guests
I fully assume all such risks, whether known or unknown, foreseeable or unforeseeable, and accept full responsibility for my participation.
2. ENVIRONMENTAL AND WILDLIFE HAZARDS:
I understand that the golf course is situated in a natural outdoor environment where I may encounter both wildlife and vegetation-related hazards, including but not limited to:
- Rattlesnakes, other snakes, and wild animals
- Insects such as bees, wasps, spiders, ants, and mosquitoes
- Thorny plants, such as cactus, mesquite trees, and other desert vegetation
- Sharp rocks, uneven surfaces, and natural debris
- Rodents or other critters
I acknowledge and accept the risk of injury, allergic reaction, punctures, scratches, or other harm that may result from contact with these environmental elements. I understand that I am responsible for exercising caution when entering rough, brushy, or non-manicured areas of the course and do so at my own risk.
3. RELEASE OF LIABILITY:
I hereby release, waive, discharge, and covenant not to sue the golf course, its owners, officers, employees, volunteers, agents, and affiliates (“Releasees”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or to any property belonging to me, whether caused by the negligence of the Releasees or otherwise, while participating in golf activities or while on the golf course premises.
4. INDEMNIFICATION:
I agree to indemnify and hold harmless the Releasees from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of my participation or presence on the golf course.
5. GOLF CART USE:
If I choose to operate or ride in a golf cart, I agree to:
- Operate the cart safely and responsibly
- Follow all posted signs and staff instructions
- Be fully responsible for any injuries or damages caused by my use or misuse of the golf cart
I understand that I am financially responsible for any damage to golf carts or other property resulting from my negligence.
6. MEDICAL TREATMENT CONSENT:
In the event of an injury or medical emergency, I authorize the golf course to obtain emergency medical treatment on my behalf, including transportation, and I accept financial responsibility for any related costs.
7. PHOTO/VIDEO RELEASE:
I grant permission to the golf course and its representatives to use photographs or videos taken of me for promotional or marketing purposes without compensation.
8. SEVERABILITY:
If any part of this agreement is found to be invalid or unenforceable, the remaining sections shall remain in full force and effect
